What We Do
The Claims Administration Section processes various forms, approves many different types of form agreements, handles certain motions, and assesses certain penalties. The Claims Administration Section also researches workers’ compensation coverage and provides advisory opinions, upon request, in claims for disfigurement under N.C. Gen. Stat. §97-31(21) or (22).
Forms
The Claims Administration Section processes many of the forms filed at the Industrial Commission. These forms include the Form 18 that is filed by employees who are making a claim for workers’ compensation benefits and the Form 18B that is filed by employees whose claim for workers’ compensation benefits involves an occupational disease caused by exposure to cotton dust, silica, or asbestos. As a claim progresses, the Claims Administration Section continues to process many forms filed by insurers and employers, including forms regarding the acceptance or denial of claims (Form 60, Form 61, and Form 63), and forms regarding return to work status (Form 28 and Form 28T).
Form Agreements
The Claims Administration Section reviews most of the form agreements that may be entered into by the parties in a workers’ compensation claim, including the Form 21, Form 26, Form 26A, Form 26D, Form 30, and Form 30D. In conjunction with these form agreements, the Claims Administration Section also reviews applications for lump sum payments made by an employee on a Form 31.
Motions
The Claims Administration Section rules on employer and carrier motions to extend the time within which to accept or deny a claim. The Claims Administration Section also rules on motions for the approval of an attorney’s fee filed during the pendency of a claim.
Workers' Compensation Insurance Coverage Search
The Claims Administration Section is responsible for researching workers’ compensation insurance coverage information and confirming that the correct workers’ compensation insurance coverage is matched up with each claim. For inquiries about coverage, please email coverage@ic.nc.gov.
Advisory Opinions
Upon request, the Claims Administration Section may provide an advisory opinion in disfigurement claims to assist the parties in reaching agreement on fair and equitable compensation for disfigurement.
