How to Submit a Secure Leave Request

Rule 11 NCAC 23E .0104 sets the requirements for filing a secure leave period request with the Industrial Commission.

  • All secure leave requests must be submitted, via the NCIC Online Services Center under 'Other Resources.' 
    (You will first need to log-in; see upper right corner on NCIC page)
  • There are two options to choose from: 'Secure Leave Request' and 'Parental Secure Leave Request.'

Secure Leave Periods for Attorneys

Secure Leave Period Definition

Rule 11 NCAC 23E .0104 sets the requirements for filing a secure leave period request with the Industrial Commission.

There are two types of secure leave periods:

  1. A partial calendar week or a complete calendar week. An attorney is entitled to secure leave periods totaling up to 15 days for any purpose. (11 NCAC 23E .0104(b))
  2. A complete calendar week within a 24-week period surrounding the birth or adoption of an attorney's child. An attorney is entitled to secure parental leave up to 12 weeks. (11 NCAC 23E .0104(c))

Secure Leave Period Written Request

A secure leave period shall be filed by letter or motion. The request shall contain all of the following:

  1. The attorney's name, mailing address, telephone number, email address, and state bar number.
  2. The date(s) for which secure leave is being requested.
  3. The dates of all other secure leave periods during the current calendar year that have previously been designated.
  4. A statement that the secure leave period is not being designated for the purpose of delaying, hindering, or interfering with the disposition of any matter in any pending action or proceeding.
  5. A statement that no action or proceeding in which the attorney has entered an appearance has been schedule, tentatively set, or noticed for trial, hearing, deposition, or other proceeding during the designated secure leave period.
  6. The expected birth date or adoption date of a child for a secure parental leave period.

Time Period for Submitting a Secure Leave Request

  1. No later than 90 days before the beginning of the secure leave period.
  2. Before any trial, hearing, deposition or other matter has been scheduled, peremptorily set, or noticed for a time during the designated secure leave period.
