Change in Industrial Commission File Numbering System:
Beginning January 29, 2009, the N.C. Industrial Commission will
assign a six-character file number beginning with a “W”—for
example, “W12345”—to all new workers’ compensation claims.
New and/or Revised
Forms and Procedures:
The N.C. Industrial Commission has revised the
Form 17, which
is now titled the N.C. Workers’ Compensation Notice to Injured Workers
and Employers. The new form can be found on our web site at
http://www.ic.nc.gov/.
Effective February 1, 2009, this form must be prominently posted, if you
have workers’ compensation insurance or qualify as self-insured. (N.C.
Gen. Stat. §97-93).
It must be printed in the same colors and format that appears on
the Industrial Commission web site.
The Commission has also issued new and/or revised versions of

and announced new

Mediated Settlement Agreement Form Adopted:
On December 3rd, the Full Commission adopted a Mediated Settlement Agreement
form designated as
Form MSC8 (PDF file). Copies of the form are available on both the
Mediation
and Forms
pages on the Commission’s web site. It is recommended that attorneys and
mediators use this form, or a similar form, to document settlements reached
at mediated settlement conferences.

Another important U.S. Supreme Court Decision: Great-West Life & Annuity Insurance Co. et al v. Knudson et al. (in PDF form). Seth Bernanke of the Charlotte bar reports that this January 8, 2002 rules that ERISA cannot subrogate against third-party proceeds. Says Bernanke: "This is especially important to comp practitioners because we were worried that the anti-Hansen changes to N.C. Gen. Stat. §97-17 would not hold up when an ERISA health insurance plan had paid the medical bills."
