MEMORANDUM
TO: All Interested Parties
FROM: Chairman Buck Lattimore
DATE: January 28, 2002
RE: Kmart
We have been informed that Kmart has filed Chapter 11 Bankruptcy in the United States Bankruptcy Court, Northern District of Illinois, Eastern Division, Case No. 02 B 02462 to 02492. Kmart was self-insured for workers’ compensation claims for a substantial period of time in North Carolina.
Kmart has sought and been granted permission by the Bankruptcy Court to
continue to process and pay all workers’ compensation claims even though the
company is within the jurisdiction of the Bankruptcy Court.
Therefore, all parties having existing or new workers’ compensation
claims should proceed with those claims as would normally occur.
If any claimant does not receive benefits to which they are lawfully
entitled or should benefits awarded be suspended or terminated for unexplained
reasons, please notify the Industrial Commission.
Questions or concerns regarding Kmart claims should be directed to:
Stephen T. Gheen, Chief Deputy Commissioner, 919-807-2540 or gheen@ind.commerce.state.nc.us.
Due to the volume of inquiries, email communication is requested if
possible, though not required.
The Industrial Commission website (www.comp.state.nc.us) will be updated as needed with additional information.
