The North Carolina Industrial Commission published a "Notice of Rule-Making by the North Carolina Industrial Commission to Revise and Update the Existing Rules for Utilization of Rehabilitation Professionals in Workers Compensation Claims" in Lawyers Weekly on 28 February 2000 and continuing through 27 March 2000, and on the Industrial Commissions web site continuously from 28 February 2000, through 30 March 2000.
Pursuant to the Notice, a Public Hearing was held on 30 March 2000, in the hearing room of the Archdale Building in Raleigh, NC., attended by all the Full Commissioners of the Industrial Commission. Attorneys Steven R. Edelstein, Victor Farah, Jeri Whitfield, Jay Gervasi, Charles Hassell, Kathleen Glancy, and Seth Bernanke, Rehabilitation Professionals Judy Sedor, Ted Sawyer, Jane Rouse, Barbara Armstrong, Maggie Kelly, Sara Golightly, Bruce Holt, Kathy Wickizer, Elga Calhoun, and Linda Koch, and Occupational Health Nurse Pat Clapp, appeared and offered comments when invited to do so at the Public Hearing. The record of the Public Hearing was held open for written comments through the close of business on 5 April 2000.
After careful review of the record, the Commission adopts the following:
North Carolina Industrial Commission Rules for Utilization of Rehabilitation Professionals in Workers Compensation Claims (see attachment)
The North Carolina Industrial Commission Rules for Utilization of Rehabilitation Professionals in Workers Compensation Claims shall become effective 1 June 2000.
The Industrial Commission takes this action pursuant to Sections 97-25.5 and 97-80(a) of the North Carolina General Statutes.
