MEMORANDUM

RE:         January 2003 Cases for Docketing

            The assistance of the workers’ compensation trial bar is needed in regard to cases being docketed for January 2003.

            The Deputy Commissioner Section has the following caseload for January 2003:

801 “regular” workers’ compensation cases/motion hearings;
18.5 days of State Tort Claim special sets;
1 week of uninsured employer/contempt cases;
4 weeks of asbestos occupational disease hearings;
1 week medical malpractice trial; and
1 docket of Prisoner Tort Claims.

The 801 regular workers’ compensation cases/motion hearings exceed the average caseload by some 350 cases. Consistent with the policy that all cases ready for trial are set, all cases scheduled will be docketed.

            Experience indicates that of the “regular” workers’ compensation/motion hearings set each month trial counsel request continuances in approximately 30% of all cases. A substantial number of continuance requests are based on the parties’ desire to return or remain in mediation.

            The cases to be docketed will be posted on the Industrial Commission’s website; www.comp.state.nc.us, during the day on November 19, 2002. The cases are being posted in three formats:

            Counsels are asked to review their cases to be docketed. Please determine if any case needs to be returned/remain in mediation or if any case is not actually ready for trail in January 2002. Also determine if any case will require four or more hours for hearing. Please email this office with the number and name of any case that meets this criteria and it will not be scheduled and no formal request for continuance/removal will be necessary. Cases that will require four or more hours of hearing will be specially set in accordance with standard procedure in February 2003 with adequate allowance on the docket for unfettered trial of the case. Opposing counsel should be copied with each request.

            Counsel should notify this office of cases that do not need to be scheduled up to Thursday, November 21, 2002 at 12:00 noon by email, if possible to gheen@ind.commerce.state.nc.us. All cases will be assigned to specific Deputy Commissioners for docketing after that time.
