RE:         November 2002 Cases for Docketing

            We are posting on the Commission Web Page (http://www.comp.state.nc.us/) the master list of cases for November 2002. The cases are being posted in three formats:

            You may search any format posted by pressing the “Control” and “F” keys of your computer. This will activate a “Find” program. Simply type the search term, the plaintiff’s last name for example, and click “Find Next.”

            If counsel or a pro se party believes that a case listed should not be set for hearing in November 2002 for any reason other than the case should remain at the mediation stage, communication should be directed to the author immediately at gheen@ind.commerce.state.nc.us with proof that a copy of any communication has been directed to any opposing party. If a case needs to be removed because it should remain at the mediation stage, the communication should be directed to Deputy Commissioner John Schafer, Mediation Coordinator, at schaferj@ind.commerce.state.nc.us.

            The docket list is not final. Additions and deletions can be made to the master list at any time prior to a particular hearing docket being published.

            Special Note: The Deputy Commissioner Section is experiencing a problem with estimates by counsel as to the length of time that a case will require for hearing. Experience indicates that the estimates provided in the Form 33 and Form 33R are often understated. Cases that require more than four hours, especially cases requiring more than one day of hearing, are designated as “special sets.” Dockets are rearranged to accommodate these cases or a Deputy Commissioner is assigned to conduct a special set hearing.

            Trial counsel who have a case that qualifies as a special set can assist the Commission by notifying the Chief Deputy Commissioner immediately following an impasse at mediation or for cases currently pending before the Deputy Commissioner Section. Early notification avoids the situation of lengthy cases being placed on a docket with inadequate time allowed for trial.
