Special Note
The tentative master docket for August 2004 is
heavier than normal given the number of available Deputy Commissioners. Trial
counsel with cases on the tentative master docket are requested to affirmatively
contact opposing counsel to ensure that cases are ready for trial in August

DOCKET HAS JUST BEEN REPOSTED. IT HAS COME TO OUR ATTENTION THAT THE CASES
POSTED YESTERDAY DID NOT CONTAIN THE MOST CURRENT INFORMATION IN REGARD TO
CASES. IF YOU CHECKED CASES ON JUNE 1, 2004, PLEASE DO SO AGAIN. WE APOLOGIZE

Effective today, workers’ compensation cases tentatively identified for docketing in August 2004 are posted on our website at www.comp.state.nc.us. The link to the August 2004 list of cases is located on the front page of the website, identified as “Master List of Cases For Docketing, August 2004, by Deputy Commissioner Section” (located below the section “Liquidations and Bankruptcies”). Cases identified for docketing in August 2004 are posted by Region/IC File Number, Alpha Plaintiff, and Alpha Defendant.
Requests for continuances, removals and potential additions are due no later than 12:00 noon, Wednesday, June 9, 2004. All requests should include the reason for the request with a copy to opposing counsel or the pro se party. If the case is still in mediation or should be mediated, please note this fact specifically. Continuances, removals and potential additions should be requested by email transmission to gheen@ind.commerce.state.nc.us.
Trial counsel are reminded that ANY case anticipated to require four or more hours for hearing is considered a “special set.” The Deputy Commissioner Section schedules “special set” cases on individual dockets to accommodate anticipated length of hearing. Counsel should review the cases posted and identify those cases that qualify as a “special set.” Immediately contact my office by email, including the anticipated length of hearing, in order to properly schedule these cases.
Deputy Commissioners are closely scrutinizing requests for continuances once trial dockets have been published. Please note that Rule 611(6)(emphasis added) specifically provides, “Hearing costs shall be assessed in each case set for hearing, including those cases which are settled after being calendared and notices mailed, and shall be payable upon receipt of a statement from the Industrial Commission.”
