Industrial Commission
MEMORANDUM
TO: Workers Compensation Trial Bar
FROM: Stephen T. Gheen, Chief Deputy Commissioner
DATE: March 11, 2002
RE: Death of Deputy Commissioner Mary Moore Hoag and Reassignment of Her Cases
Deputy Commissioner Mary Moore Hoag’s untimely death last week
necessitates that the cases pending before her be reassigned for completion.
We are currently producing a list of all cases pending before Deputy
Commissioner Hoag.
Parties in such cases will receive written notice within the next week that another Deputy Commissioner will be assigned to individual cases for closing of the record and issuance of an Opinion & Award. It has been the traditional practice of the Industrial Commission, under these circumstances, to complete cases by reassignment rather than order new hearings. Absent some compelling reason for a new hearing, cases will be reassigned.
Until such time as the parties receive notification, parties should continue to take all necessary action to close records. Correspondence should be sent to the Chief Deputy Commissioner until a new Deputy Commissioner is designated. Should the parties need to immediately consult with the Industrial Commission concerning any of the cases, please call on me. Correspondence by email to gheen@ind.commerce.state.nc.us is preferred but not required.
Thank you for your understanding in these circumstances. The Industrial Commission will make the transition of these cases as timely as the circumstances permit.
