MEMORANDUM

TO:         All Interested Parties

FROM:   Chairman Buck Lattimore

DATE:    February 25, 2002

RE:         Bankruptcy of This End Up

We have been informed that This End Up (THU) filed Bankruptcy in the United States Bankruptcy Court in the year 2000. Our current understanding is that claims of TEU were paid. No claims as of this date have been referred to the North Carolina Self-Insurance Guaranty Association (NCSIGA).

TEU was self-insured for workers’ compensation claims for a relatively brief period of time in North Carolina. Based on information obtained from the North Carolina Department of Insurance, TEU was self-insured from December 10, 1995 through May 31, 1996. Following May 31, 1996, Travelers Insurance Company insured TEU.

Any claimant with a claim whose case was incurred during the short period of self-insurance who is experiencing non-payment of a claim should contact the North Carolina Self-Insurance Guaranty Association as follows:

Catherine C. Stuart
Stuart Law Firm. PLLC
4101 Lake Boone Trail
Raleigh, North Carolina 27607
(919) 787-6050
Fax:  (919) 787-9988

If any claimant experiences problems with TEU claims for insured periods questions should be directed to: Stephen T. Gheen, Chief Deputy Commissioner, (919) 807-2540 or gheen@ind.commerce.state.nc.us. Communication by email is requested if possible, though not required.

The Industrial Commission website (www.comp.state.nc.us) will be updated as needed with additional information.
