MEMORANDUM

RE: Liquidation of PHICO Insurance Company
The State of
Pennsylvania ordered the liquidation of PHICO Insurance
Company. As designated in North Carolina General Statutes Chapter 58, Article 48,
the North Carolina Insurance Guaranty Association (NCIGA) is now a successor in interest
and party in all workers compensation claims filed against PHICO.
N.C. Gen. Stat. §58-48-5 allows the Guaranty Association a 120-day stay in the
proceedings for all claims including any pending compromise settlement
agreements. Accordingly, the
Commission has suspended processing PHICO cases in accordance with the automatic
stay.
It is recommended
that claimants having PHICO cases notify the NCIGA of their existing claim.
For all new claims being filed, notice to the NCIGA is essential.
