RE:         Burlington Industries

We have been informed that Burlington Industries has filed Chapter 11 Bankruptcy in the United States Bankruptcy Court, District of Delaware, Case No. 01-11282. Burlington was self-insured for workers’ compensation claims for a substantial period of time in North Carolina.

Burlington Industries has sought and been granted permission by the Bankruptcy Court to continue to process and pay all workers’ compensation claims even though the company is within the jurisdiction of the Bankruptcy Court. Therefore, all parties having existing or new workers’ compensation claims should proceed with those claims as would normally occur.

If any claimant does not receive benefits to which they are lawfully entitled or should benefits awarded be suspended or terminated for unexplained reasons, please notify the Industrial Commission. Questions or concerns regarding Burlington claims should be directed to: Stephen T. Gheen, Chief Deputy Commissioner, 919-807-2540 or gheen@ind.commerce.state.nc.us. Due to the volume of inquiries, email communication is requested if possible, though not required.
