Order Adopting Rules

Order Adopting Rules relating to (a) additions to the chiropractic fee schedule, (b) adoption of a durable medical equipment/supply fee schedule, (c) deletion of obsolete CPT codes, (d) adoption of fees for physicians' assistants, (e) establishment of hospital fees for workers' compensation cases, (f) reimbursement for multiple arthroscopic procedures, and (g) amendment of Industrial Commission Rule 104.

The North Carolina Industrial Commission published a "Public Notice of Rule-Making by the North Carolina Industrial Commission" in Lawyers Weekly from 20 November 2000 through 18 December 2000, and on the Industrial Commission's web site continuously from 13 November 2000 through 8 January 2001.

Pursuant to the Notice, the Industrial Commission held a Public Hearing on 19 December 2000 in the N.C. Utilities Commission Hearing Room, located on the second floor of the Dobbs Building, 430 N. Salisbury Street, Raleigh, NC.

The following persons appeared and offered comments when invited to do so at the Public Hearing: Jennifer Gudac, Chief Medical Fee Examiner of the Industrial Commission; Dr. David Dupuy of Charlotte Orthopaedic Specialists; Michael Long, head of Physician Assistant Department of Charlotte Orthopedic Specialists; Scott Rheinecker, Physician Assistant at Miller Orthopedic Clinic; Dr. David Kingery of Miller Orthopedic Clinic; Marty Rosenberg, CEO of Miller Orthopedic Clinic; Dr. John Welshofer of Miller Orthopedic Clinic; Bill Vaassen of Burke Occupational Health; Lanny Parker, President of N.C. Academy of Physician Assistants; Dr. E. Harvy Estes of the N.C. Medical Society; Marvin Musselwhite representing the N.C. Orthopedic Association; Spencer Cole, physician assistant with Raleigh Orthopedic; and Hank Patterson of Patterson, Harkavy & Lawrence.

The record of the Public Hearing was held open for written comments through the close of business on 29 December 2000.

After careful review of the record, the Commission adopts the following, all of which shall be effective 1 March 2001 (except for Attachment E that shall be effective January 1, 2001):

Attachment A, additions to the chiropractic fee schedule;

Attachment B, adoption of a durable medical equipment/supply fee schedule;

Attachment C, deletion of obsolete CPT codes;

Attachment D, adoption of fees for physicians' assistants;

Attachment E, establishment of hospital fees for workers' compensation cases;

Attachment F, reimbursement for multiple arthroscopic procedures, and

Attachment G, amendment of Industrial Commission Rule 104.
